        Beijing Jingwei HiRain Technologies Co., Ltd. and its Affiliated Companies (“we” or “us” or “our”), value your privacy. This Privacy Policy applies to all products and services provided by us and describes how we collect, use and disclose your personal information and respect your privacy rights, which is any information that is capable of identifying you as an individual person, collected via all websites or apps that post a link to this Privacy Policy (collectively, “the Sites”). This Privacy Policy describes how we handle and protect your personal information in connection with the Sites, in our capacity as data controllers.

        The use of our services may involve the collection and use of your Information (as defined in the “What kinds of information do we collect and how we use your information” section below) on our services. It is important for you to understand how this happens and how you may control it, so please read this Privacy Policy carefully.

1.Scope of this Privacy Policy

        Please note that this Privacy Policy does not apply to Information collected: (i) through third party services (including any third party websites) that you may access through our services; or (ii) by other companies and organizations who advertise their services on our services.

 

2.What kinds of information do we collect and how we use your information

         “Information” is Personal Information and Non-Personal Information;

        "Personal Information" means any information or combination of information that relates to you, and can be used to identify you. Personal Information may include the following:

        · information you make available to us when you creating an account or use our services, such as your name, telephone number, email address and company name;

        ·information you make available to us when you apply for our position such as your personal basic information (such as name, gender, date and/or year of birth, nationality, address, marital status, telephone number, email address, family relations), self-evaluation, personal education and work information (such as personal occupation, jobs, education, work and project experience).

        ·information we collect for better providing products and services for you, such as your name, telephone number, email address, interested scopes;

        ·Creating an account, processing your registration as a user, providing you with a log-in ID for the Sites and maintaining and managing your registration;

        We may also collect and use non-personally identifiable information. Non-personally identifiable information is information that cannot be used to identify a particular individual. For example, we will collect statistical data, such as the numbers of visits to its website. We collect this data to understand how users use our websites, products, and services so that we can improve our services and better satisfy your needs. In addition, in the process of submitting your resume, if you provide the additional information such as your foreign language ability, computer skills and other professional skills, it will help us to better evaluate your abilities. We may collect, use, process, transfer, or disclose non-personally identifiable information for other purposes at its own discretion.

 

        We will endeavor to isolate your personal information from non-personally identifiable information and ensure that the two types of information are used separately. If personal information is combined with non-personally identifiable information, it will still be treated as personal information during processing.

3.1 Cookies

        To ensure our website works correctly, we may at times place a small piece of data known as a cookie on your computer or mobile device. If you click the link, we will track your visit to help us learn about your preferences for products and services and improve our customer service. You can unsubscribe from our mailing list at any time if you do not want to be tracked in this manner.

For example, we verify the global uniqueness of accounts before allowing them to be registered.

Examples of these service providers include companies that provide hot-line services, send email, or provide technical support on behalf of us. The service providers can use your information only for the purpose of providing services to you on behalf of us.

        We will ensure that the lawfulness of this sharing and sign stringent non-disclosure agreements (NDAs) and/or data processing clauses with the companies, organizations, and individuals with whom personal information is shared, requiring them to comply with this Policy when processing personal data.

        We do not transfer personal information with other companies, organizations and individuals unless one of the following circumstances applies:

We will ask the new organization that holds your personal information to continue to be bound by this Policy, or we will ask the organization to re-ask you for authorization.

        We do not disclose personal information with other companies, organizations and individuals unless one of the following circumstances applies:

        ·Disclosing pursuant to laws and regulations:To comply with applicable laws or respond to valid legal procedures, we may also disclose your personal information to law enforcement or other government agencies.

        ·Disclosing when appropriate:We may also disclose your information when appropriate, for example, to execute Terms and Conditions, when we believe disclosure is necessary or appropriate to prevent physical harm or financial losses, or when it is in connection with an investigation of suspected or actual illegal activity.

 

4.4 Exceptions

        In the following circumstances, sharing, transferring and disclosing your personal information does not require prior authorization from you:

        ·Relating to national security and national defense security;

        ·Relating to the major public interest in public safety and public health;

        ·Relating to criminal investigation, prosecution and execution of judgment;

        ·In order to safeguard your or other personal life and property rights but difficult to obtain your consent;

        ·Personal information you disclose to the public;

        ·Personal information collected from legally disclosed information, such as government information or legal news reports etc..

        In accordance with the laws, where sharing and transferring personal information that has been pseudonymised, and ensuring that the information receiver cannot recover and re-identify the subject of personal information, is not an act of external sharing and transfer and public disclosure of personal information, the preservation and processing of such data will not need to notify you separately and obtain your consent.

 

5.How we protect and retain your personal information

        The security of your personal information is important to us. We use appropriate physical, management, and technical measures to protect your personal information from unauthorized access, disclosure, use, modification, damage, or loss. For example, we use protection mechanisms to prevent attacks, and access control mechanisms to permit only authorized access to your personal data. We also provide training on security and privacy protection for employees to raise their awareness of personal data protection. We are committed to protecting your personal data; however, please note that no security measure is perfect.

        Please be aware that despite our efforts, no data security measures can guarantee 100% security at all times. Our systems and the communications networks through which you access our services may be subject to security breaches and failures which are due to circumstances beyond our reasonable control.

        In addition, within some of our services, we may offer you options to amend or delete, and/or change how we and the public can view and/or access, your personal information and/or shared information within those services – in which case, please log into your account with us within the relevant service and make the appropriate changes.

        We will retain your personal information for no longer than is necessary for the purposes stated in this Policy, unless otherwise extending the retention period is required or permitted by law. The information storage period may vary with scenario, product, and service. The standards we use to determine the retention period are as follows: the time required to retain personal information to fulfill business purposes, including providing products and services; maintaining corresponding transaction and business records; controlling and improving the performance and quality of products and services; ensuring the security of systems, products, and services; handling possible user queries or complaints and locating problems; whether the user agrees to a longer retention period; and whether the laws, contracts, and other equivalencies have special requirements for information retention; etc. We will maintain your registration information as long as your account is necessary for service provision. You can choose to deregister your account. After you deregister your account, we will stop providing you with products and services through your account and delete your relevant personal data, provided that deletion is not otherwise stipulated by special legal requirements. However, it is important to note that communications made by you using our services may put your personal information in the hands of third parties that we cannot control – for example, if you have previously made your personal information public via our services. In some instances, we may not be able to delete your personal information and/or shared information from our services or systems – in which case we will (where reasonably practicable) let you know why we are unable to do so.

        In the case of your personal information breach, we shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal information breach to the supervisory authority competent if you are in the European Union, unless the personal information breach is unlikely to result in a risk to the rights and freedoms of you. 

 

6.How to access and control your personal information

        It is your responsibility to ensure that all personal information submitted to us is correct. We are dedicated to maintaining the accuracy and completeness of personal data and keeping the information up-to-date.

        To the extent required by applicable law, you may (i) have the right to access certain personal information we maintain about you, (ii) request that we update or correct inaccuracies in that information, (iii) object or restrict to our use of your personal information, and (iv) ask us to delete your personal information from our database. You may direct such request to us by sending email to market_dept@hirain.com. Your written request may be required for security. We will respond to all requests under this “How to access and control your personal information” section within 30 days. We may decline the request if we have reasonable grounds to believe that the request is a fraudulent, unfeasible or may jeopardize the privacy of others.

        If allowed by applicable laws, you have the right to withdraw your consent at any time when we processes your personal data based on your consent. However, withdrawal does not affect the legitimacy and effectiveness of how we process your personal data based on your consent before the withdrawal is made; nor does it affect any data processing based on another justification other than your consent.

7.How we process juveniles’ personal information

        Our websites, products and services are primarily intended for adults. A juvenile must not create an account without the consent of a parent or guardian. If a juvenile's personal data is collected with prior parental consent, we will only use or disclose the data as permitted by law, with the explicit consent of the juvenile's parents or guardians, or when necessary for the protection of the juvenile. If we accidentally collect a juvenile's personal information without verified prior consent from the juvenile's parents, we will attempt to delete the data as soon as possible.

 

8.Third-party providers and their services

        To ensure a positive user experience, you may receive content or web links from third parties other than us and our partners ("third parties"). We do not have the right to control such third parties, but you can choose whether to use the links, view the content and/or access the products or services provided by third parties. We cannot control the privacy practices and information protection policies of third parties that are not subject to this Policy. When you submit personal information to such a third party, please read and refer to the privacy protection policy of the third party.

        This Privacy Policy only applies to any Information collected by us, does not apply to any services offered by or information practices of any third parties, and we bear no liability for any third party use of any Information provided by you to them.

 

9.International transfers of your personal information

        As a global company, your personal information collected by us may be processed or accessed in the country/region where you use our products and services or in other countries/regions where we or our affiliates, subsidiaries, service providers or business partners have a presence. These jurisdictions may have different information protection laws. In such circumstances, we will take measures to ensure that information is processed as required by this Policy and applicable laws, which includes when transferring the data subject’s personal information from the EU to a country or region which have been acknowledged by the EU commission as having an adequate level of data protection, we may use a variety of legal mechanisms, such as signing standard contractual clauses approved by the EU Commission, obtaining the consent to the cross-border transfer of a data subject in the EU, or implementing security measures like anonymizing personal data before cross-border data transfer.

        We may from time to time update, revise or add specific instructions, policies and terms to this Privacy Policy. We will release the latest Privacy Policy on this page for any changes.

        Where we consider that any changes to this Privacy Policy are reasonably material, we will notify you through different channels, for example, posting a notice on our website or sending you direct notification, prior to the change becoming effective.

        By continuing to use our services after any changes to this Privacy Policy, with or without notice from us, you are agreeing to the revised Privacy Policy.
